Prior to League participation all coaches, parents/guardians of climbers under 18 years old, and all climbers 18 years old or older must agree to the following in their coach/climber account:

I have read, understand and will apply the COVID Protocols posted on the website. Furthermore, as an adult age 18 or older, I have carefully read and voluntarily sign the Affirmation, Assumption of Risk, Release and Waiver of Liability, and Indemnity Agreement below and that I am giving up substantial rights by agreeing to its terms.

I AFFIRM, ACKNOWLEDGE, REPRESENT AND WARRANT AS FOLLOWS:
(I) I AM FULLY EXECUTING THE ASCL PARTICIPATION AGREEMENT AND WAIVER AND RELEASE OF LIABILITY WHICH INCLUDES, AMONG OTHER THINGS:
(1) AN ASSUMPTION OF RISK OF EXPOSURE TO COMMUNICABLE AND INFECTIOUS DISEASES; AND (2) THAT COVID IS SUCH A DISEASE;
(II) THE PARTICIPATION AGREEMENT AND WAIVER AND RELEASE OF LIABILITY, INCLUDING BUT NOT LIMITED TO THE CLAUSES ADDRESSING ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY, AND INDEMNIFICATION, FULLY APPLY TO ACTUAL AND ALLEGED CLAIMS, DEMANDS, LOSSES, INJURIES OR ILLNESSES RELATED TO COVID.

ON BEHALF OF MY CHILD/WARD I HEREBY ASSUME FULL RESPONSIBILITY FOR, AND RISK OF ILLNESS, BODILY INJURY, DEATH, PROPERTY DAMAGE OR OTHER LOSSES WHICH COULD ARISE DUE TO NEGLIGENCE, ACTIVE OR PASSIVE, OR OTHERWISE WHILE USING EQUIPMENT OR FACILITIES PROVIDED BY AND/OR WHILE PARTICIPATING IN OR OBSERVING ANY EVENT PROGRAM AFFILIATED WITH THE ASCL.

I further expressly agree that all of the foregoing is permitted and governed by the laws of Colorado and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

IF SIGNING ON BEHALF OF A MINOR: This is to certify that I understand that all of the foregoing is made on behalf of my minor child and/or legal ward. I represent and warrant to the ASCL that I have full authority to sign this agreement on behalf of such minor. As a parent/guardian with legal responsibility for this participant, I have read and explained the provisions in this agreement to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and protocols for protection against COVID. My child/ward understands and accepts these risks and responsibilities and I, my spouse (if applicable) and child/ward have read, understand and agree to all of the terms stated above.
